The book "Philosophy of Freedom" by Myroslav Popovych is part of the "Great Scientific Project" series, which collects the works of various authors. Myroslav Volodymyrovych was a great Ukrainian philosopher and thinker, an outstanding personality, and for many years he headed the Institute of Philosophy named after G. Skovoroda. In different years, he wrote articles and essays that were published in various journals in Ukraine and abroad. "Philosophy of Freedom" is a collection of essays and thoughts, which he himself systematised during the last months of his life. The author witnessed many historical events, and remembering them, he sought to understand why everything happened this way and not the other, whether anything could have been changed, whether the past of the Ukrainian people had an influence on them. Popovych searched for the truth, because it was the most important goal for him, and now posterity can find out what conclusions he reached. The topics of his interest vary, but mostly he researched theories and objects, and analysed historical events.

Recent anthropological interest in ethics and historical explorations of 'self-fashioning' have led to extensive study of the virtuous self, but existing scholarship tends to pass over the kind of morality that involves legalistic reasoning. Rules and ethics corrects that omission by demonstrating the importance of rules in everyday moral life in a variety of contexts. In a nutshell, it argues that legalistic moral rules are not necessarily an obstruction to a rounded ethical self, but can be an integral part of it. An extended introduction first sets out the theoretical basis for studies of ethical systems that are characterised by detailed rules. Besondere Angriffsflächen bietet die Standardform einer Gesetzesmoral, der die Rechtfertigung über alles geht, bis ihr die Motivationskraft abhanden kommt. Ihre Aporien und Paradoxien treten unverblümt zutage, wenn man Schlüsselthemen wie Freiheit, Rechtsgleichheit, Macht und Gewalt heranzieht. Diesseits und jenseits der Moral zeigen sich ethische Überschüsse in Form von Tugendmustern, Motivationen, Leidenschaften oder Gesten des Gebens mitsamt einer religiösen Aura. Es begegnen uns fremde Ansprüche, die weder einem allgemeinen Sollen noch einem individuellen Wünschen gehorchen. Jahrhunderts sich seit den spätern 60er Jahren bis kurz vor seinem Tod im Jahre 1998 kontinuierlich mit moraltheoretischen Fragen auseinandergesetzt hat. Der vorliegende Band präsentiert erstmals die wichtigsten Texte Luhmanns zu einer Theorie der Moral. Luhmanns großes Projekt – eine Theorie der Gesellschaft – bestimmt auch seinen Blick auf die Moral, die er nicht, wie in der Philosophie üblich, substantiell betrachtet, sondern funktional. In einer individualisierten Gesellschaft stellt sich aus seiner Perspektive stets die Frage, wie Handlungskoordinationen auf der Ebene der Interaktionen möglich sind. Hier gewinnen moralische, aber auch rechtliche Regeln und Konventionen ihre Bedeutung. Um diese zu erfassen, bedarf es laut Luhmann einer Reflexionstheorie der Moral, deren Konturen in den hier versammelten Aufsätzen sichtbar werden.

In Leticia, einem kolumbianischen Dorf am Amazonas, trifft der Autor auf einen alten Herrn aus Santo Domingo, der ihn in ein Gespräch über die Grundlagen der Moral verwickelt. Den Ort gibt es wirklich, der alte Herr und das Gespräch dagegen sind fiktiv. Der Dialog entzündet sich zunächst an Tugendhats bisheriger Moralphilosophie, insbesondere am Begründungsbegriff, den er in seinen Vorlesungen über Ethik entwickelt hat. Moralische Normen, so erklärt der alte Herr, seien per definitionem Handlungsregeln, die als begründungsbedürftig angesehen werden, aber sie können nicht an und für sich begründet werden, sondern sie sind gegenüber den Betroffenen zu begründen. Im weiteren Verlauf des Gesprächs geht es um den Gerechtigkeitsbegriff und den moralischen Universalismus, um Sitten und Konventionen, um moralische Motive und schließlich auch um die "Blutrünstigkeit" der Moral: Die Moral der Herzensgüte wird als hölzernes Eisen verworfen. Am Ende des Gesprächs wenden sie sich dem Problem der Korruption in modernen Gesellschaften zu und erwägen den Vorschlag, Korruption zu entmoralisieren und nur durch externe Sanktionen zu unterbinden.
